Terms of Use

This Terms of Use Agreement (“Agreement”) is entered into by and between DynaMount LLC, a California limited liability company (“Company,” “we,” “us,” or “our”), and the user (“User” or “you”) of the robotic hardware and software applications provided by the Company.

1. ACCEPTANCE OF TERMS

By accessing or using the robotic hardware and software applications provided by the Company (collectively, the “Products”), you agree to comply with and be bound by the terms and conditions of this Agreement.

2. DEFINITIONS

  1. “Robots” refers to physical machines manufactured by the Company.
  2. “Apps” refers to the software applications developed by the Company, including but not limited to those compatible with Mac, PC, iOS, and Android.
  3. “Control Commands” refers to the instructions or signals sent between the Robots and Apps for their operation.

3. REGISTRATION AND ACCESS

You must provide a valid email address to register for an account to use our Products (see our Privacy Notice). An account may be registered through any one of our Apps, and the same account is valid and may be used across all of our Apps. You are responsible for all activities that occur under your account. If you create an account or use the Products on behalf of another person or entity, you must have the authority to accept these Terms on their behalf.

4. LICENSE GRANT

Subject to compliance with the terms of this Agreement and the registration of a valid account, the Company grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Products for personal or commercial purposes.

5. PROHIBITED ACTIVITIES

  1. Reverse Engineering: User agrees not to reverse engineer, decompile, disassemble, or attempt to derive the source code of the Products, including the Robots, Apps, and Control Commands exchanged between them.
  2. Unauthorized Software: User shall not create or use any unauthorized software, scripts, or applications for controlling the Robots without obtaining an appropriate API license from the Company.
  3. Use with Other Hardware: User agrees not to use the software for controlling any hardware other than the Robots manufactured by the Company.
  4. Third-Party Software and Tools for Automation: No third-party software or tools may be used independently or in conjunction with the Company’s software in order to control the Robots in an automated manner without explicit written authorization from the Company.
  5. Unauthorized Access: User shall not interfere with, disrupt, or attempt to gain unauthorized access to the Products or their related systems and networks.

6. AUTOMATION AND API LICENSE

If the User desires to engage in automated control of the Robots, an API license must be purchased from the Company. Automated control without a valid API license is strictly prohibited.

7. COMMERCIAL USE

It is permitted to use the Robots and Apps for commercial purposes, subject to compliance with this Agreement.

8. INTELLECTUAL PROPERTY

All intellectual property rights in and to the Products are and shall remain the exclusive property of the Company. Nothing in this Agreement grants the User any rights to use the Company’s trade names, trademarks, service marks, logos, domain names, or any other brand features.

9. TERMINATION AND SUSPENSION

You are free to stop using our Products at any time. We reserve the right to suspend or terminate your access to our Products or delete your account if we determine:

  • You breached the terms of this Agreement.
  • We must do so to comply with the law.

11. CHANGES TO THESE TERMS OR OUR PRODUCTS

The Company reserves the right to update or modify this Agreement at any time without prior notice. As we are continuously working to develop and improve our Products, we may update these Terms or our Products accordingly from time to time. For example, we may make changes to these Terms or the Products due to:

  • Changes we make in the usual course of developing our Products.
  • Changes to the law or regulatory requirements.
  • Security or safety reasons.
  • Circumstances beyond our reasonable control.

All changes will be effective as soon as we post them to our website. Your continued use of the Products after such modifications will constitute your acknowledgment of the modified Agreement and agreement to abide and be bound by the modified terms.

12. TRADE CONTROLS

You must comply with all applicable trade laws, including sanctions and export control laws. Our Products may not be used in or for the benefit of, or exported or re-exported to (a) any U.S. embargoed country or territory or (b) any individual or entity with whom dealings are prohibited or restricted under applicable trade laws. Our Products may not be used for any end use prohibited by applicable trade laws.

13. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of California. All claims arising out of or relating to these Terms will be brought exclusively in the federal or state courts of San Diego, California.

By using the Products, the User acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this Agreement.
